Enforcement of the Data Protection Act

General description of enforcement actions (powers of investigation, inspection and/or sanction): The Data Protection Act 2004 has the following powers:

  • Powers to obtain information
  • Powers of investigation
  • Power to carry out prior security checks
  • Powers of entry and search
  • Effect service of notices to data controllers and data processors,
  • Powers to carry out compliance Audits
  • Part III of the Data Protection Act 2004 describes the powers of the commissioner in detail
Number of decisions, opinions, recommendations in previous year: Two decisions have been provided in 2015.

However, this year the Data Protection Commissioner has provided 8 decisions on investigation of complaint till date.

Last year, a guide was published to provide guidance on the usage of unmanned aircraft systems (UAS) for processing personal data for personal and professional/ commercial use.

Significant decisions, opinions or recommendations: In 2015, this office has received a total of 72 written requests for advice on data protection comprising of 42 from private bodies and 30 from ministries and governmental departments.
